Competitions

1. General

  1. These general competition terms and conditions (“General Competition Terms”) apply to all competitions organized by WEAREONE.WORLD BV with registered office at Korte Vlierstraat 6, 2000 Antwerp, Belgium and registered in the CBE with number 0867.239.782 ("Organizer"), alone or with a partner or a third party under the name, through and/or as part of the “Tomorrowland Academy – Online Academy” (“Online Academy”) which is accessible on: https://platform.academy.tomorrowland.com/ (“Platform”) (the “Contests”). With regard to each Contest individually, specific competition terms and conditions (the “Specific Terms”) will apply, as indicated on the corresponding contest page on the Platform (the “Contest Page”).
  2. By entering a Contest, the competition entrant (the “Entrant”) acknowledges having read, understood and fully accepts these General Competition Terms, as well as the Specific Terms, which can be consulted on the Contest Page, together with any specific instructions and terms for such competition which may be mentioned in any electronic messages, or on the Platform, or communicated to the Entrant in any other way (“Competition Information”). In the event of inconsisteny: the Specific Terms shall prevail over these General Competition Terms and the Competition Information shall prevail over the Specific Terms. 
  3. Organizer has the right, in its sole discretion,  to amend the Contest, Competition Information, Specific Terms and/or these General Competition Terms from time to time and will keep the Entrant adequately informed. 
  4. The invalidity or unenforceability of any provision of these General Competition Terms, the Specific Terms and/or the Competition Information shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, the corresponding terms and conditions shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
  5. In the event that any Entrant does not, or is unable to, comply with and meet these General Competition Terms, the Specific Terms and/or the Competition Information, Organizer shall be entitled at its sole discretion to disqualify such Entrant, without any further liability to such Entrant. In these circumstances, any prize(s) won by the Entrant may be forfeited and Organizer reserves the right to reclaim any prize(s) already distributed to the Entrant. Any Entrant must comply with any reasonable directions given to him or her by Organizer with regard to the Contest including but not limited to any and all relevant laws, rules and applicable regulatory codes.

2. Entrants

  1. Contests are open to natural persons from all nationalities. For entering the Contests, Entrants must be at least 18 years of age or have received their parent’s or guardian’s express permission to participate. Participation of a minor in the Contest implies such permission was received. 
  2. Staff and co-workers of the Organizer as well as staff and co-workers of other companies that are (directly or indirectly) concerned with the organization of the Contest and those living in the same household of each such individuals are explicitly excluded to enter the Contest.  
  3. Entering the Contest is free of charge and does not imply any purchase obligation.

3. Duration

  1. The Specific Terms indicate when the Contest opens and closes.  
  2. Any entries received before the opening and after the closing of the Contest will be invalid and will not be entered into the Contest. The date of the entries will serve as proof.

4. Prize

  1. Unless expressly mentioned otherwise in the Specific Terms, only 1 person shall be rewarded as the winner (“the “Winner”) of the Contest.
  2. The competition prize (the “Prize”) with regard to each Contest will be described in the Specific Terms thereof. 
  3. All products and/or services other than those explicitly mentioned in the Specific Terms are excluded from the PRIZE.
  4. The Prize is always strictly personal and non-transferable. It shall only be awarded to the Winner and can only be claimed by the Winner in accordance with these General Competition Terms and the Specific Terms. The Prize cannot be exchanged for other products, services nor cash. The Prize is indivisible and can only be accepted as such.
  5. The Winner acknowledges that if the Prize would include tickets to any event, the general terms and conditions applicable to those tickets and event shall apply to the tickets included in the Prize as well.
  6. The Winner accepts and acknowledges that if the Prize would include specific activities, certain guidelines/instructions may be given the Organizer and/or his representatives with regard to the such activities and Winner undertakes to behave in a professional manner and as a “bonus pater familias” in the completion thereof. Winner shall in this respect always communicate and behave in a manner which is reasonably not deleterious towards the Organizer, the Tomorrowland Academy and/or the companies involved in the organization of the Contest and/or the Prize.

5. Entry

  1. The Specific Terms will describe with regard to each Contest how Entrants may enter the Contest. 
  2. Mostly, an internet connection will be required in order to enter the Contest. Any costs related to such internet connection must be entirely borne by the Entrant. Any such costs cannot be reimbursed by the Organizer.
  3. In order to validly enter the Contest, the Entrant must accept the General Competition Terms, the Specific Terms and privacy policy. By entering the Contest and submitting an entry, Entrant is deemed to have accepted all of the aforementioned terms.
  4. By entering the Content and submitting an entry, Entrant warrants that all information submitted by him/her is true, current, and complete. Only fully completed entries will be considered valid and will be taken into account in the Contest. 
  5. The Entrant shall refrain from submitting material that may be considered illegal, damaging, obscene, threatening, infringing third parties’ privacy or intellectual property or trademark rights, politically incorrect, inciting to violence, racist, disrespectful, or in general contravening public order or common decency or for other reasons is not suitable for publication.  The Organizer reserves the right to refuse such entries at his sole discretion and without prior notification. 
  6. The Organizer reserves the right at its discretion and at any time to reject any entries that are incomplete, incomprehensible, incorrect, inaudible, lost, damaged in any way, made or received after the deadline for receiving entries has passed or which are otherwise deficient or not in accordance with the present General Competition Terms and/or Specific Terms. The Organizer also reserves the right to reject entries that are unlawful, indecent, racist, inflammatory, defamatory or which can be considered to be otherwise harmful or offensive in any way. The Organizer accepts no responsibility for any incorrect, incomplete, late, lost or misdirected entries included but not limited to entries not (or not completely) received due to technical disruptions or issues, network congestion, loss in service of online entry mechanisms, computer or technical errors or any other reason. The Organizer cannot enter into correspondence with Entrants who experience difficulties when entering online. Any entries received which are in any way in breach of these General Competition Terms and/or the Specific Terms will be void and will be disqualified from the Contest.
  7. Unless expressly mentioned otherwise, only one entry per person is allowed. No more than one prize per person will be awarded. Entries submitted through agents or third parties or in bulk (i.e. more entries than a human being could submit in the time available without the use of software or other devices designed to make automated entries) will not be accepted.
  8. In the event of any fault, mistake, misunderstanding or dispute concerning the correctness or acceptability of the entry or any answers given by Entrants (if applicable), or the operation of any part of the Contest, the decision of Organizer shall be final and no correspondence will be entered into.
  9. Organizer will not be liable to reimburse expenses incurred in making an entry in the Contest, even if the entry is refused, rejected or cancelled in accordance with these General Competition Terms and/or the Specific Terms. 
  10. Any Entrant who enters or attempts to enter the Content in a manner, which in Organizer’s determination is contrary to these General Competition Terms and/or Specific Terms or by its nature is unfair to other entrants may be removed from the Contest at Organizer’s sole discretion.

6. Selecting the winner

  1. The selection process of the Winner depends on the type of Contest:
    1. If the Contest entails that Entrants must provide the correct answer to a specific question and such question has one (1) correct answer, the Winner will be the Entrant who has provided such correct answer and whose response to the shifting question is closest to the correct response. If multiple Entrants have provided the one (1) correct answer and a response to the shifting question that is just as close to the correct response, the Winner will be randomly selected from such entries, if required by law or regulation, under the supervision of an independent observer.
    2. If the Contest entails that Entrant must submit data which requires a subjective assessment (e.g. a creative response, a personal opinion or a sample), the selection of the Winner will be done by the Organizer or as indicated in the Specific Terms and/or Competition Information and, if required by law or regulation, an independent judge or a panel including one member who is independent of the Contest’s promoters and intermediaries. Unless the Specific Terms and/or Competition Information indicate otherwise, the following criteria will be considered in the selection of the Winner: quality (including application of the relevant instructions), creativity, originality, positivity, fitness with the Tomorrowland values of respect, love, equality, diversity, universality and unity.
  2. The WINNER will be selected within thirty (30) days of the date on which the Contest closes. The selection of the Winner by the Organizer shall be final and no correspondence will be entered into about the General Competition Terms, Specific Terms, the Competition Information, the organization, the selection of the Winner, the Prize and/or the result of the Contest.
  3. Should more prizes be claimed than are available for any reason, a simple prize draw will take place for the available prize(s).
  4. Organizer may in its sole discretion refuse to provide a prize, or seek its recovery, in the event of non-entitlement under and/or Entrant’s breach of these General Competition Terms or the Specific Terms, in case of fraud, dishonesty, or other inappropriate or improper conduct including but not limited to the use of technology which enables an Entrant to evade entry requirements.

7. Contacting the winner

  1. Organizer will attempt to notify the Winner within 10 days of the date on which the Contest closes. The Winner will be contacted via the data provided when, respectively account through which the entry was posted. The Winner will have a specified fixed time period, as indicated in the notification from the Organizer, in which to claim his or her Prize. If Organizer is unable to notify the Winner, or if the Winner fails to respond within the fixed time period as specified and/or provide an address for delivery of the Prize, this may result in forfeiture of the Prize and ORGANIZER reserves the right to select an alternative winner, being the Entrant who is ranked one (1) place below the original Winner or, if several Entrants are ranked one (1) place below the original Winner by random pick from such entries.
  2. Organizer shall within 30 days from the date on which the Winner is selected, inform the Winner about the collection of the Prize, unless otherwise specified to the Winner. The Prize will be delivered to the (digital) address provided by the Winner. Delivery restrictions may apply, as communicated by Organizer to the Winner. No cash equivalent (where applicable) or alternative prize will be given and the Prize is personal, non-transferable and non-exchangeable. However, Organizer reserves the right to change the Prize due to circumstances beyond its control or to offer an alternative of similar value.

8. Privacy

  1. By submitting his/her entry (including personal data), the Entrant agrees to Organizer processing those details for the sole purpose of the Contest (including announcement of the Winner) and in accordance with Organizer’s privacy policy which can be viewed at www.tomorrowland.com/privacy
  2. Organizer shall comply with all applicable requirements of the General Data Protection Regulation, any successor legislation or other applicable law.

9. Intellectual property rights (including portrait rights)

  1. Entrants warrant that they are the copyright owners of and/or have all necessary licenses and rights to use and submit the copyright protected content included in their entry, e.g. mixes, tracks, photographs and drawings, and Organizer’s use of such works (which Entrant permits) will not infringe the rights of any third party. Tomorrowland cannot be required to obtain further licences, provide attribution or pay royalties or other compensations to any third parties. Tomorrowland is entitled to cancel/remove the Entrant’s entry, if Tomorrowland is informed by a third party about an infringement and/or if Tomorrowland is requested by a third party to pay royalties or any other compensation in relation with content included in such entry.
  2. Entrants who are a) affiliated with or member of a performing-rights organization (“PRO”), b) under contract with a record label, and/or c) have assigned their rights to a music publisher, must notify those parties of the royalty-free license granted to Tomorrowland regarding copyright protected content provided by it. The Entrant is solely responsible to ensure compliance with its reporting and/or contractual obligations, and (if applicable) obtaining consent of that party to grant such royalty-free licenses in relation to the Contest in accordance with these General Competition Terms and the Specific Terms.
  3. Each Entrant represents and warrants that any content provided by it in relation to the Contest and containing licensed music is not subject to and Tomorrowland cannot be obligated to pay royalties to any third party, including without limitation copyright owners regarding any sounds (such as record labels), any musical works (such as music publishers), PRO’s (such as SABAM, SACEM, SESAC, BMI, ASCAP, etc.) or any other third parties in relation to content provided in relation to the Contest.
  4. The Contest may not be used for activities that include intellectual property infringements. Entrants may not create, generate, or distribute through the Contest any copyright protected content if and to the extent the Customer does not have the rights for granting licenses in relation thereto. 
  5. The Entrant grants Organizer a free, worldwide, transferable and non-exclusive right to use, reproduce and distribute the submitted material within the framework of the Contest and/or any of Organizer’s activities including use of the submitted material for internal and external communication and marketing purposes without any limitation in time or territory.
  6. Moreover, the Organizer shall have the royalty-free right to use and distribute the submitted material in whole or in part in any format and via all (social) media known to the public.  The Organizer reserves the right to adapt or arrange the submitted material depending on the needs of the medium by all technical means processes, however with respect for the integrity of the Entrant. 
  7. If the Entrant is proclaimed as Winner of the Contest, the Entrant also grants the Organizer the free, worldwide, transferable and non-exclusive right to use, reproduce and distribute his/her name, surname, the content and data provided as part of the entry, image and voice as well as any material created in the collection of the Prize within the framework of the Content and for internal and external communication and marketing purposes without any limitation in territory, this through all media for a period of 12 months after closing of the Contest. 
  8. The Entrant waives any and all right to compensation in any form whatsoever for the grant of rights as described in this clause.
  9. The Entrant shall defend and hold harmless the Organizer from and against any claim from any third party including a collecting rights society, with regard to the material submitted by the Entrant, notwithstanding the right of Organizer to refuse or withdraw the material at its sole discretion and without prior notice.
  10. The Winner may create content for use on social media regarding the Prize in mutual agreement with the Organizer.

10. Liability

  1. To the maximum extent permitted by applicable law, the Organizer and third parties (directly or indirectly) involved in the organization of the Contest and/or the Prize cannot be held responsible for any damage of whatever nature as a consequence of the organization of or entering into the Contest, the selection of the Winner, the awarding of the Prize or the consequences of accepting the Prize. 
  2. The Organizer reserves the right to modify, revise, interrupt, cancel, postpone the Contest or any aspect thereof in case of Force Majeure or in general circumstances beyond control of the Organizer, amongst others but not limited to court decisions, without this giving rise to any liability, claim and/or damages.    
  3. Printing, spelling or setting faults or technical or other problems with respect to or on the occasion of the Contest (including in these General Competition Terms, the Specific Terms and/or the Competition Information) cannot be used to claim any kind of damages, obligation or liability on the part of the Organizer, nor can the Organizer be held liable for a technical problem whereby the Contest cannot be entered, nor for technical problems that may impede the continuous and uninterrupted course of the Contest.
  4. The Organizer can under no circumstances be held responsible for incorrect personal details (name, telephone number, address, e-mail address, etc.) provided by the Entrant, resulting in an incorrect or unknown address of the Entrant.
  5. If (a part of) the Prize does not arrive on time as a result of loss and/or delay in delivery by the postal services, and/or the postal services damage (part of) the Prize deliberately or otherwise, the Organizer can under no circumstances be held liable in that regard.
  6. The Winner shall be liable towards the Organizer for any and all damages caused by its actions in the collection of the Prize.

11. Communication and disputes

  1. No communication, other than mentioned in the present General Competition Terms and the Specific Terms shall take place regarding the Contest, neither by telephone nor in writing.
  2. The relationship between the Organizer and the Entrant is governed by Belgian law only. Any disputes between the Organizer and an Entrant concerning the existence, interpretation, carrying out and consequences of this Contest and the applicable Terms, fall under the exclusive jurisdiction of the courts of Antwerp, Belgium.

12. Cancellation of the prize / force majeure

  1. In case the Prize cannot be awarded due to cancellation of the subject (e.g. in the event the Prize includes tickets for a certain event) or Force Majeure, the Organizer will be released from its obligations towards the Winner and will have no further liability towards the Winner or Entrants.
  2. The term Force Majeure as used in the present General Competition Terms shall mean any cause or causes not reasonably within the control of Organizer and which, by the exercise of reasonable diligence, Organizer is unable to prevent or overcome, including (without being limited thereto) acts of God, strikes, lockouts or other industrial disturbances, internet disturbances and/or failures, acts of the public enemy, acts of terror, sabotage, wars, blockades, military action, insurrections or riots; epidemics; landslides, subsidence, lightning, earthquakes, fires, storms or storm warnings; crevasses, floods or washouts; civil disturbances; explosions, inability of Organizer to obtain, after the exercise of reasonable diligence, necessary materials, supplies, rights of way or permits; or any action or restraint by any governmental authority. 

13. General terms and conditions of the event/activity  

By entering a specific Contest and if the Prize regarding such Contest includes tickets to a specific event/activity, the Entrant explicitly acknowledges to accept the general terms and conditions applicable to such event/activity, without any reservations and/or conditions.
